Academy terms of sale
General terms of sale for the training courses.
This is an English translation of the French original. If this English version differs from the French version in any way, the French version prevails. French law applies.
1. Purpose and scope
These general terms of sale govern the sale by Nahouda (the Seller; 38 Boulevard Halidi Selemani, 97600 Mamoudzou, Mayotte; allo@nahouda.fr) of access to online training courses to any adult (the Customer), whether a consumer or a business. The courses are online educational content: they do not give rise to any public funding or training agreement.
2. Courses and prices
Each course is described on its page: content, duration and technical requirements. Prices are shown in euros and displayed before payment. VAT not applicable, article 294-1 of the French General Tax Code: the displayed price is the price to pay, for individuals and businesses alike. The price to pay is the one displayed on the day of the order.
3. Order and payment
The Customer chooses a course, checks the summary, then confirms the order with the “Order with obligation to pay” button. Payment is made in full, by card, through a secure payment provider: Nahouda never stores card numbers. The order is confirmed by email, together with the invoice, which also remains available in the customer area.
4. Access to the course
Access is personal and lasts at least 12 months from the order, and then for as long as the course is published. If Nahouda withdraws a course, the Customer is notified 60 days in advance. The Customer is responsible for their device and connection: a recent browser and a sufficient connection are required.
5. Right of withdrawal
A Customer who is a consumer has 14 days from the order to withdraw without giving a reason, by email to allo@nahouda.fr. A free preview of the first module lets the Customer judge the course before buying.
As the content is digital and supplied online, the Customer may ask for immediate access: by ticking, before paying, the box “I request immediate access and I waive my right of withdrawal”, the Customer acknowledges that this right is lost as soon as access begins (article L221-28 of the French Consumer Code). Nahouda confirms this agreement and waiver by email. If the box is not ticked, access is opened at the end of the 14 days, during which the Customer may withdraw and obtain a full refund.
Withdrawal form. To Nahouda, allo@nahouda.fr: “I hereby notify you of my withdrawal from my order of the course [title], placed on [date]. Name: [name]. Address: [address]. Date: [date].”
6. Refund outside the withdrawal period
Once access has begun, no refund is due, except in the event of a proven technical failure of Nahouda making the course inaccessible for more than 7 consecutive days. The consumer’s statutory guarantees (article 9) remain applicable.
7. Personal use and intellectual property
Nahouda grants the Customer a personal, non-exclusive and non-transferable right of use for the duration of access. The content remains the property of Nahouda. The following are prohibited: sharing the account, downloading, copying and distributing the videos and documents. For several learners, one licence per person is required; groups are handled by quotation. In the event of abuse, the account may be suspended without refund, after a warning except in serious cases.
8. Updates, help and certificate
Updates to the course are included for the duration of access, including those needed for its compliance, with no commitment as to dates. Help is available by email at support@nahouda.fr, with a reply within 3 working days without a firm commitment; there is no tutoring. At the end of a course, a certificate of attendance may be issued: it is neither a diploma nor a recognised certification.
9. Liability
The courses help you master tools: Nahouda does not guarantee any result, in particular professional or financial, and is bound only by an obligation of means. The platform is made available on a best-effort basis, and maintenance is announced when possible. Nahouda’s liability is limited to the price paid for the course concerned, subject to the rights that the law mandatorily grants to consumers. A Customer who is a consumer benefits from the statutory guarantee of conformity of digital content and services (articles L224-25-1 et seq. of the French Consumer Code), which is in addition to these terms.
10. Personal data
The Customer’s data (identity, purchases, progress) is processed as described in the privacy policy.
11. Complaints
Any complaint may be sent to support@nahouda.fr.
12. Governing law and disputes
These terms of sale are governed by French law. For a Customer who is a business, the courts within the jurisdiction of Mamoudzou have sole jurisdiction. A Customer who is a consumer may bring the matter before the court of their place of residence or any court that has jurisdiction under the law.
13. Changes to the terms
Amended terms apply to orders placed after their publication. The version in force on the day of purchase remains the Customer’s version; the history of versions is kept on this page.
14. Language
These terms of sale are written in French. In the event of a translation into another language, only the French version is authentic.
