Account terms
The rules for creating and using your Nahouda account.
This is an English translation of the French original. If this English version differs from the French version in any way, the French version prevails. French law applies.
These general terms (hereinafter the “Terms”) govern the creation and use of the Nahouda account, accessible at nahouda.fr/compte, published by El Fahed NAHOUDA (hereinafter “Nahouda”), 38 Boulevard Halidi Selemani, 97600 Mamoudzou (see the legal notice). The Nahouda account is the common entry point to the products of the Nahouda Group. Each product (Plizsign, Swiftpliz and the following ones) remains governed by its own general terms of use and, for paid subscriptions, by its general terms of sale. In the event of a contradiction, those texts prevail as regards the product itself, and these Terms prevail as regards the account.
1. Definitions
- Account: the Customer’s personal area on nahouda.fr/compte, which brings together their identity, security, products, licences and billing.
- Customer: the person, natural or legal, who creates an Account. They are a consumer when they act for purposes that do not fall within their commercial, industrial, craft, professional or agricultural activity, and a business in the opposite case.
- Product: a service of the Nahouda Group accessible from the Account, notably Plizsign (electronic signature) and Swiftpliz (file sharing).
- Licence: the right to use a Product at a given tier, free, paid or offered, attached to the Account.
- Nahouda Connect: the single identity that lets the Customer log in to the Products with one account.
2. Purpose
These Terms define the rules for creating the Account, its security, attaching Products, managing billing and closing the Account. The Account is free of charge. Only subscriptions to the Products may be paid, under the conditions of their terms of sale.
3. Creating the Account
To create an Account, the Customer provides accurate information and an email address that they control, which they confirm through the link received. They keep this information up to date, in particular their billing details. The Customer declares that they have the capacity to contract. A minor may create an Account only with the consent of their legal representative. An Account is personal: the Customer neither transfers nor lends it.
4. Account security
The Customer is responsible for the confidentiality of their credentials and for the use made of their Account. They are encouraged to enable two-factor authentication by app, not to reuse a password and, where the feature is offered, to register a passkey on a device they control. Nahouda keeps a log of logins and sensitive operations, which can be viewed in the Account, and informs the Customer by email of events that affect their security, notably a login from a new device. The log covers the last 180 days. The Customer informs Nahouda without delay, at support@nahouda.fr, of any unauthorised use of their Account.
5. Products and Licences
The Customer attaches Products to their Account by signing up to them or by subscribing to a Licence. The Account shows their Licences, their tier and their expiry, and lets them open each Product. A Licence offered by Nahouda is offered for the period shown in the Account, without billing. The transfer of a Licence or a space to another person follows the rules of the Product concerned and takes effect after acceptance by the recipient.
6. Billing
Paid subscriptions are taken out and paid through Stripe, the payment provider. Nahouda does not keep any full bank card data. From the Account, the Customer views and downloads their invoices, updates their payment method and billing details, changes tier or cancels a subscription. Prices, duration, renewal, the consumer’s right of withdrawal and the consequences of a missed payment are set by the Product’s terms of sale.
7. Support
Support is provided by email at support@nahouda.fr. Only following a request for assistance made by the Customer to Nahouda, and where handling it requires it, a member of the Nahouda team may access the Customer’s Account for a maximum of eight hours. The Customer is informed of this by email, the access appears in the Account log, and sensitive operations on the Account remain prohibited during this access. The request for assistance constitutes the Customer’s agreement to this access.
8. Duration, closure and deletion
The Account is concluded for an indefinite period. The Customer may delete it at any time. When the Account holds no active Licence, its deletion is immediate. When it holds one, including a free one, the request is passed to the Nahouda team, which handles it after the Licences have been closed. After deletion, Nahouda keeps the invoices for the legal period of ten years and sends the Customer a copy on simple request to support@nahouda.fr. Deletion entails the deletion of the Account data, subject to the retention periods required by law, notably for invoices, and those described in the privacy policy. It is for the Customer to retrieve, before deletion, their invoices and the data of their Products.
Nahouda may suspend or close an Account in the event of a serious breach of these Terms or of the terms of a Product, after informing the Customer and allowing them a reasonable period to remedy it, except in an emergency or where required by law. These provisions do not limit any right that the law grants to the consumer.
9. Personal data
For managing the Account, its security, billing and support, Nahouda acts as data controller. The processing, its purposes, the retention periods, the recipients and the rights of individuals (access, rectification, erasure, portability, objection) are described in the nahouda.fr privacy policy. The Customer exercises their rights from their Account where the feature exists, or at support@nahouda.fr.
10. Liability
Nahouda uses reasonable means to ensure the availability and security of the Account, without any quantified availability commitment. A Customer who is a consumer keeps all the rights that the law grants them, and nothing in these Terms limits their statutory guarantee or their right to compensation. For a Customer who is a business, Nahouda is bound by an obligation of means and is not liable for indirect damage; the liability limits of each Product apply to its use.
11. Changes to the Terms
Nahouda may amend these Terms. Any substantial change is notified to the Customer by email at least 30 days before it takes effect. A Customer who refuses it may delete their Account free of charge before that date, after cancelling their subscriptions in accordance with the Products’ terms of sale. Continued use of the Account after that date constitutes acceptance.
12. Acceptance
These Terms are accepted expressly, by ticking the box provided for this purpose, either when signing up to a Product, or at the first login to the Account when they have not yet been accepted, or when accepting a new version. Acceptance given once applies to the Account and is not requested again for the same version. The acceptance is recorded with its date, the version accepted, the IP address and the user agent.
13. Governing law and jurisdiction
These Terms are governed by French law. In the event of a dispute, and failing an amicable resolution:
- Customer who is a business: the courts of Nahouda’s registered office have sole jurisdiction.
- Customer who is a consumer: they may bring the matter before the court of their place of residence (article R631-3 of the French Consumer Code) or, in accordance with Regulation (EU) No 1215/2012, the French courts or those of their place of residence, at their choice.
14. Language
These Terms are written in French. In the event of a translation, only the French version is authentic.
